General

Legal 

We will meet the client’s requirements within the objectives.

The entire risk as to the quality and performance of the work is with the client. In no event will The Wise Owl be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate the website, even if The Wise Owl has been advised of the possibility of such damages. The Wise Owl guarantees that all aspects of design and construction of the project will be disclosed to the Client upon completion, and full copyrights and ownership will be the property of the Client once full payment has been received.

Time-frames 

All time-frames given for work undertaken are estimates. In no event will The Wise Owl be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising from delivering any work within a given time-frame. Additional hourly charges may be incurred if the project time extends outside of the timescale due to:

  • Lack or delay of correspondence from the client.

  • Slow or delayed delivery of content from the client.

  • Changes to the initial spec/proposal by the client.

Revisions & stopping work 

The client may be charged additional fees if they decide to make changes to the agreed upon project scope and objectives.

If the Client stops work on a project, work completed shall be invoiced at the hourly rate, and deducted from the total cost quoted.

Reflection period

Once a website project is complete, unless agreed otherwise, the client has 14 days to request any changes that relate to:

  • Functionality problems, small tweaks, spelling mistakes 

After care plan

The Wise Owl may offer at its discretion a free 12 month care plan to provide 60 minutes of our time per month for providing general website maintenance as required. Free care plan hours cannot be accumulated or rolled over into a new month.

Payment Terms

The Wise Owl requires a deposit to begin the project. Work will begin after deposit is received. The remainder of payment is due within 7 days of the final invoice issue. Failure to complete payment will result in interest being charged per every unpaid week and we will reserve the right to restrict the services that we provide until payment is received. 

Payment for care plans, hosting and SEO campaigns is required in advance to the month/period the service is provided. In the case that The Wise Owl acts on behalf of a client to register a domain/hosting, it will be registered using domain privacy and set to auto renew on expiry. It is the client’s responsibility to inform The Wise Owl if they wish or intend to not renew the domain/hosting registration, otherwise the domain/hosting will be automatically renewed and billed to the Client accordingly. We do not offer refunds for any hosting fees. If you require to move your website/emails to another host, we require 30 days written notice.

Exclusions

Any amount quoted for website projects, unless explicitly stated or agreed otherwise, excludes hosting of the website, domain name registering, video and image stock licenses and any additional licenses required for the operation/running of the website, outside of those agreed in the proposal.

Payment Terms

You will be invoiced at the end of every month. Payment is required within 7 days of issue of invoice. Failure to do so will result in interest charged per every unpaid week. If we do not receive payment within 7 days of issue of invoice we will reserve the right to restrict the services that we provide.
